Terms & Conditions of Sale
Effective 15 October 2026
1. About these Terms
- These Terms & Conditions of Sale (“Terms”) govern every purchase from classicwarehouse.com.au, by phone or email, and at our warehouse. They also govern your use of our website.
- The seller is Nehme Corp Pty Ltd (ACN 624 674 791, ABN 28 624 674 791) trading as Classic Warehouse (“Classic Warehouse”, “we”, “us”, “our”). “You” means the person or business placing an order.
- Our Delivery Terms, Refunds & Returns Policy and Privacy Policy form part of these Terms. If they conflict, these Terms prevail, except that the Privacy Policy governs how we handle personal information.
- By placing an order you confirm that you have read and accept these Terms, and that you are at least 18 years old or are ordering with the consent of a parent or guardian.
2. The Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, that is implied or imposed by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or by any other legislation that cannot lawfully be excluded or limited (“Non-Excludable Rights”). Every clause in these Terms is to be read subject to those rights.
3. Product information
- Images and colour. We take care to present our products accurately. Photographs, renders, room visualisations and on-screen colours are illustrative only. They can differ from the goods supplied because of lighting, screen settings and natural product variation.
- Shade and batch. Ceramic, porcelain and natural stone products vary in shade, tone, veining and texture between production batches and within a batch. Crazing in glazed wall tiles is a recognised characteristic of some products. These characteristics are not defects. Samples represent the product range, not the specific batch you will receive.
- Sizes. Tile sizes are nominal, in line with industry practice. Actual dimensions, thickness and calibre can vary slightly between shades and batches. You, or your builder or tiler, should confirm actual dimensions before setting out the job.
- Slip ratings. Slip resistance classifications, such as P-ratings under AS 4586, are indicative and based on the manufacturer’s test results for a representative sample. Results can vary between batches. Choosing a product with appropriate slip resistance for a particular location, including any requirement of the National Construction Code, is the responsibility of the purchaser, designer, builder or certifier.
- Technical data. Coverage per box, weights and technical specifications are supplied by manufacturers and published in good faith. Quantities calculated with our online tools are estimates, and the final quantity ordered is your decision.
4. Prices and promotions
- Prices are in Australian dollars and include GST unless stated otherwise. Delivery fees are shown separately.
- Promotional prices apply only to orders placed and paid for within the promotional period shown. Promotions cannot be combined unless we state otherwise. They do not apply retrospectively to earlier orders, and they exclude samples unless stated.
- We may change prices at any time. A price change does not affect an order we have already accepted.
- If a product is displayed at an obviously incorrect price because of a typographical, system or supplier error, we may decline or cancel the order. If we do, we will refund all money paid in full, or offer you the product at the correct price.
5. Orders and acceptance
- Your order is an offer to purchase. A contract is formed when we confirm acceptance by email or dispatch the goods, whichever happens first. An automated order acknowledgement is not an acceptance.
- All orders are subject to availability. If any item is unavailable, we will contact you to offer an alternative, a revised supply date or a refund for that item.
- We may decline or cancel an order for legitimate reasons, including suspected fraud, an inability to deliver to the nominated address, or an error in the order. If we do, we will refund any amount paid for the affected items.
6. Payment
- Payment is due in full at the time of order, using a payment method offered at checkout. Goods are not released for delivery or collection until payment has cleared.
- Payments are processed by our third-party payment providers. We do not receive or store your full card details.
- We may carry out verification checks on any order and may ask for identification before releasing goods.
7. Delivery fees are estimates
- The delivery fee shown on our website and at checkout is an estimate. It is calculated from the total weight of your order and the delivery state. It assumes standard kerbside access as described in our Delivery Terms.
- If the actual cost of delivering your order differs from the estimate, for example because of the delivery location, site access or the size of the load, we will contact you within one business day of your order, and before it is processed, to confirm the adjusted fee.
- You may then accept the adjusted fee or cancel the order for a full refund, including the delivery fee you paid. We will not process your order on an adjusted fee without your agreement.
8. Cancelling an order
- You may cancel an order by contacting us before it is dispatched or collected. A cancellation fee of 5% of the price of the goods applies, to cover payment processing and handling costs. No cancellation fee applies where you cancel under clause 7.3, or because we have not met a delivery date we confirmed to you.
- Once an order has been dispatched or collected, it cannot be cancelled. Our Refunds & Returns Policy applies instead.
- Special-order, indent and made-to-order products cannot be cancelled once we have placed the order with the supplier.
9. Ordering the right quantity
- Please order enough product to complete your whole project at once, with an allowance for cuts, breakages and future repairs. For most layouts this is at least 10%, and more for diagonal, herringbone or complex patterns.
- Later orders may come from a different batch, and we cannot guarantee a match in shade, tone or calibre. Supplementary orders are charged at the price current when they are placed, plus the applicable delivery fee.
10. Inspection before installation
- Before any product is fixed, you, or your builder or tiler, must inspect the goods to confirm they are the correct product, shade, batch, size and calibre, and are free of visible defects. Shade and batch codes are printed on each box. Lay out tiles drawn from several boxes in good light before installation begins.
- If anything appears incorrect, do not install the product. Contact us immediately so we can resolve it before work proceeds.
- Installing a product indicates that its visible characteristics were accepted. Subject to your Non-Excludable Rights, we are not responsible for removal, re-laying, labour, delay or associated costs arising from the installation of goods whose shade, batch, size, calibre or other characteristic was apparent on reasonable inspection before installation.
11. Installation, use and maintenance
- We supply goods only. We do not install them, and we do not supervise or certify installation. Products should be installed by a competent tradesperson in accordance with AS 3958.1, the manufacturer’s instructions and the National Construction Code.
- Tiled surfaces should be protected during construction. Grout residue and haze must be removed in line with the grout manufacturer’s instructions. Textured and anti-slip surfaces need more frequent cleaning than smooth surfaces.
- Acids, harsh chemicals and abrasive cleaners can permanently alter a tile’s surface, finish and slip resistance. Subject to your Non-Excludable Rights, we are not responsible for damage or changes in performance caused by unsuitable cleaning products, sealers or treatments.
- Any advice we give about product selection, quantities or suitability is general guidance. It does not replace the advice of your designer, builder, tiler or certifier, who are responsible for specifying and installing products for your site.
12. Refunds and returns
Our Refunds & Returns Policy forms part of these Terms. In summary:
- Report damaged, incorrect or missing goods within 48 hours of delivery, with photographs. Inspect collected goods before leaving our warehouse.
- Faulty goods are dealt with in accordance with the Australian Consumer Law.
- Change-of-mind returns are accepted within 30 days of delivery or collection. Goods must be full, unopened boxes in original, resaleable condition from a current batch. A 25% restocking fee applies, and return freight is at your cost.
- Opened or part boxes, used, cut or installed goods, clearance and discontinued lines, special orders and samples cannot be returned for change of mind.
- Approved refunds are paid to your original payment method within 10 business days of our receiving and inspecting the goods.
13. Title and risk
- Risk in the goods passes to you on delivery to the nominated address, or when goods are loaded onto your vehicle or your carrier’s vehicle at our warehouse.
- Ownership of the goods passes to you when we have received payment in full and that payment has cleared.
14. Liability
- Subject to your Non-Excludable Rights, we are not liable for any indirect or consequential loss. This includes loss of profit, loss of opportunity, and delay costs or penalties under building contracts, however caused.
- If you acquire goods for the purpose of re-supply, or goods not of a kind ordinarily acquired for personal, domestic or household use or consumption, our liability for a failure to comply with a consumer guarantee is limited, where the law permits, to replacing the goods or supplying equivalent goods, or paying the cost of doing either.
- Subject to your Non-Excludable Rights, our total liability in connection with any order is limited to the price paid for the goods concerned.
15. Trade and business customers
Where you buy in the course of a business, you are responsible for passing relevant product information, including the matters in clauses 3, 9, 10 and 11, to your client, installer and anyone else who relies on the goods. Account and credit facilities, where offered, are subject to separate written terms.
16. Website use and intellectual property
- All content on our website, including text, photography, graphics, tools, logos and the Classic Warehouse name, belongs to us or our licensors. You may view and print it for your personal, non-commercial use. You must not copy, reproduce, scrape or republish it without our written consent.
- You must not use our website in a way that is unlawful, interferes with its operation or security, or infringes anyone’s rights.
- We aim to keep our website available and accurate, but we do not guarantee that it will be uninterrupted or error-free.
17. Events beyond our control
We are not liable for delay or failure to perform caused by events beyond our reasonable control. These include extreme weather, natural disasters, industrial action, supplier or carrier disruption, shipping delays, pandemics and government action. If such an event substantially delays your order, either of us may cancel the affected part of the order, and we will refund any amount paid for undelivered goods.
18. Privacy
We handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
19. Disputes and governing law
- If you have a concern about an order, please contact us first. We will work with you in good faith to resolve it promptly. You may also contact NSW Fair Trading or your local consumer protection agency at any time.
- These Terms are governed by the laws of New South Wales. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
20. Changes to these Terms
We may update these Terms from time to time by publishing a revised version on our website. The Terms in force when you place an order apply to that order.
